EchoDrop Terms of Service

Effective date: October 19, 2025

These Terms of Service ("Terms") govern access to and use of the EchoDrop platform and related services (collectively, "Service"). Please read them carefully before using EchoDrop.

By creating an account, using the Service, or accessing any part of echodrop.app, you agree to these Terms. If you do not agree, you must not use the Service.

1. Who We Are

EchoDrop ("we", "us", or "our") offers a cloud-based Software-as-a-Service (SaaS) platform for collecting and managing feedback in real time.

2. Scope and Updates

These Terms apply to all current and future plans, including free and paid tiers.

Updates to these Terms will be posted on this page with a new effective date. Continued use after changes means you accept the revised Terms.

3. Account Registration and Eligibility

To use EchoDrop you must:

  • Be at least 16 years old (the minimum age under GDPR for consent in Germany/EU)
  • Provide accurate, complete information during sign-up
  • Maintain confidentiality of login credentials

Account Responsibility:

Accounts may represent individuals, teams, or organizations. You are responsible for all actions under your account or workspace.

We may suspend or delete accounts that are:

  • Inactive for an extended period
  • Used in violation of law or these Terms
  • Posing a risk to the Service's integrity

4. Service Model and Plans

EchoDrop provides:

  • A free plan with basic features
  • Paid subscription plans with enhanced functionality
  • Optional add-ons or upgrades

Subscription Details:

Subscription information, feature tiers, and prices are shown before purchase. Subscriptions renew automatically each billing period, unless cancelled through your in-app account settings or the dedicated "Cancel subscription" button (§ 312k BGB compliance). Cancellation takes effect at the end of the current billing period.

We may modify plan names or included features from time to time, provided no material reduction of core functionality occurs for the duration of your paid period.

5. Payments and Refunds

Payment Processing:

Payments are handled exclusively by Dodo Payments (our payment processor), supporting:

  • PayPal
  • Credit card
  • Google Pay
  • Apple Pay

Pricing and Taxes:

All charges are displayed inclusive of applicable taxes unless stated otherwise.

Refund Policy:

Payments are non-refundable once the service begins, as EchoDrop provides digital content that is immediately executed and accessed upon payment (§ 356 (5) BGB; Directive 2011/83/EU Art. 16 m).

By purchasing, you expressly:

  • Request immediate access to the Service, and
  • Acknowledge that this waives your statutory 14-day withdrawal right for digital content

Failure to process payment may result in suspension or termination of access.

6. Use of the Service

You agree not to:

  • Use EchoDrop for unlawful, unethical, or infringing purposes
  • Engage in unauthorized scraping, reselling, or performance testing
  • Attempt to break, bypass, or reverse-engineer any security feature

Team Responsibilities:

Team owners may invite collaborators and are responsible for accepted invitations and all content within their workspace.

7. Feedback Content and User Data

When you collect feedback through EchoDrop:

Your Role as Controller:

  • You own the relationship with your respondents and act as data controller under GDPR

EchoDrop's Role as Processor:

  • EchoDrop processes the collected responses on your behalf as data processor, in accordance with the Data Processing Agreement (DPA)

Limited License:

By using EchoDrop, you grant us a limited, worldwide, non-exclusive license to process, host, and anonymize your content only as necessary to:

  • Operate and improve the Service
  • Generate analytics, demos, or performance optimization
  • Without identifying individuals

8. Intellectual Property

EchoDrop's Rights:

EchoDrop retains all rights, title, and interest in its software, brand, and intellectual property.

Your Rights:

Users retain ownership of their collected feedback and content. No ownership is transferred through account creation or subscription.

Restrictions:

You may not copy, modify, or distribute any part of EchoDrop's software except as allowed under these Terms.

9. Service Availability and Changes

EchoDrop strives for high uptime but provides no absolute guarantee of uninterrupted availability. Maintenance windows and incidents may occur.

We may modify, suspend, or discontinue parts of the Service if technically or legally necessary. Users will be notified in advance of any significant changes affecting functionality or pricing.

10. Termination and Account Deletion

Your Right to Delete:

You may delete your account at any time in your profile settings. Deletion permanently removes your data unless retention is required by law or covered by our legitimate interests (security logs, billing records).

We May Suspend or Terminate Access If:

  • You violate the Terms or applicable law
  • Your account remains inactive for an extended time
  • Continuation would expose us or others to legal or security risk

Upon termination, your right to use the Service ends immediately.

11. Data Protection and Confidentiality

Compliance:

EchoDrop complies with the EU General Data Protection Regulation (GDPR) and German data-protection law.

Personal data is handled according to our Privacy Policy.

Confidentiality:

All users must treat non-public information obtained through the Service as confidential.

12. Liability

Limitation of Liability:

EchoDrop's total liability for all claims within a contract year is limited to the amount you paid for the Service in the 12 months preceding the claim.

This Limitation Does Not Apply To:

  • Liability for intent or gross negligence
  • Liability for injury to life, body, or health
  • Claims under the German Product Liability Act
  • Mandatory liability under data-protection law

Service Disclaimer:

The Service is provided "as is" and "as available" without warranties of uninterrupted operation, fitness for a particular purpose, or error-free performance.

13. Cancellation Button and Consumer Information

For consumer users with paid subscriptions, a "Cancel subscription" button is available in the account dashboard in accordance with § 312k BGB. Clicking it leads to a confirmation page clearly stating the termination date.

Professional or business accounts remain governed by contract or invoice terms defined in their workspace.

14. Governing Law

Applicable Law:

These Terms are governed by the laws of the Federal Republic of Germany. German mandatory consumer protection rules remain unaffected.

Jurisdiction:

If you are a business user, place of jurisdiction shall be Bergkamen, Germany unless mandatory law provides otherwise.

16. Final Clauses

Severability:

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect.

Waiver:

No waiver shall be deemed granted unless in writing.
